Sulton Law Firm is monitoring a new civil rights lawsuit alleging racial discrimination by Allegiant Air and its parent company, Allegiant Travel Company. According to the complaint, plaintiffs Igor Leal and Giovana dos Santos Salazar, Hispanic passengers from Orlando, Florida, were denied boarding on September 23, 2024, on a flight from Appleton, Wisconsin to Sanford, Florida after experiencing harassment tied to their ethnicity and limited English proficiency. The allegations have not yet been proven in court.
Allegations in the Complaint
The plaintiffs assert that during boarding they were stopped without explanation for a supposed ticket issue, then permitted to board before being shouted at about a bag. They further allege they were subjected to racist comments—including “That’s why we need a wall” and “I can’t stand these types of people.” When Mr. Leal requested employee names, staff allegedly concealed their badges, refused to identify themselves, and called law enforcement while misrepresenting the incident. The plaintiffs state they were ultimately denied boarding, forced to buy new tickets, and suffered humiliation, fear, and distress.
Legal Claims
The lawsuit brings claims under 42 U.S.C. § 1981, alleging that Allegiant Air and Allegiant Travel Company denied the plaintiffs the same contractual rights and treatment afforded to white passengers, based on race and national origin. The complaint characterizes the conduct as intentional and willful.
Relief Sought
The plaintiffs seek:
- A declaratory judgment that federal law was violated;
- Compensatory damages for emotional distress and related harms;
- Punitive damages for willful discrimination;
- Attorneys’ fees and costs, prejudgment interest, and other equitable relief.
Section 1981 protects against race-based interference in the making and enforcement of contracts—including the purchase and use of airline tickets. Allegations of discriminatory denial of boarding raise significant questions about equal access and treatment in commercial air travel.
